MOTHER CANNOT GIVE UP THE MAINTENANCE RIGHTS OF HER DAUGHTER

Wherein consent terms were arrived at by both parties and the mother gave up her right to maintenance, stridhan, and alimony, the Supreme Court had no issues. However, finding fault with the mother giving up her child’s maintenance in consent terms, the Supreme Court opined that a mother does not have the right to give up on her child’s right to receive maintenance from her father. These rights rest all-together with the child itself and the mother cannot take away her rights to claim maintenance.
